So I recently inherited property from my father that passed away last year. I went through probate and everything was fine. I was the sole heir and the executor of the will.
In March I contacted a family friend and offered to sell the property. When we went to close the property, turns out my father's ex-wife's name is still on the deed to one of the parcels.
The buyer wants both parcels. My dad's ex-wife hasn't shown any interest in the property since they divorced 1984.
I hired an attorney and filed a quiet title action.
The guardian ad litem has contacted this woman. She messaged me on Facebook and demanded half of the property value or she would sue me.
Like I said before she's had no interest in the property in 42 years. She's never paid taxes on it. She's never lived on the property or had a dwelling on the property. She's demanding money only because it's convenient.
I'm sure someone on Reddit has been through this in the past. There's probably lawyers on here that can give me a quick answer. Thanks

blushandbrooks I wouldn't pay her anything just because she demanded it. But I also wouldn't assume you automatically win because she hasn't paid taxes or used the property in decades. Property rights can survive a very long period of inactivity, and the details matter. The fact that her name is still on the deed is the reason you're having this problem in the first place.
Gold Safe2861 Pay her nothing. Have no contact You are paying a lawyer to sue her as well as negotiate any potential settlement. Let your attorney handle it.

Longjumping_Bad9555 Your father's ex owns half of the parcel with her name on it. Period.
Reese9951 Showing no interest doesn't negate her 1/2 ownership interest. She owns 1/2 so you'll likely have to pay her 1/2 of what it sells for.
OGSoley It seems to me that you are having a very strong emotional reaction to what she is doing here. That is understandable. I would, too. But you will have a much easier time navigating this situation if you try to set that emotional reaction and emotional investment aside while seeking advice (legal or nonlegal) and deciding what steps to take next. I mean this as kindly as possible, and I say it as someone who has a fair amount of experience dealing with clients and litigants dealing with v
RosesareRed45 I am a lawyer, not your lawyer. In NC, divorce decrees and property settlements are not necessarily determined at the same time. If her name is on the deed, she has an ownership interest in the property regardless of whether she paid taxes or not. You do not have a clear title. Most NC divorces are based on one year separation and a property settlement agreement. Some couples get divorced before they settle the division of assets.
